Requesting access for deceased patients

If you are seeking to access the records of someone who has died; for example a family member please refer to the below information.

Access will usually be granted if the request has been made from a personal representative of the deceased patient, provided that they hold the role set out in law, this is normally the person who hold probate documentation or the person who is named as executor in the decreased will.

If you are not the personal representative of the deceased but you have a claim arising, then you may have the right to see the health record but only if they are necessary to your claim. However, the duty of confidentiality still applies after a patient has died, we will not always grant access.
